By agreeing to these terms, you waive your right to a jury trial or class action.

9.2. Arbitration Administration

• Third-Party Administrator: The arbitration will be administered by the AAA’s Miami Regional Office located at 1111 Brickell Avenue, Suite 1950, Miami, FL 33131, in case this address changes,  My Secret Studio will choose the nearest location in Miami Dade.
• Single Arbitrator: The dispute will be decided by one (1) neutral arbitrator selected by mutual agreement or appointed by the AAA.
• Governing Rules: The AAA’s Consumer Arbitration Rules and Supplementary Procedures for Consumer-Related Disputes will apply.AAA Rules

9,3. Cost Allocation

• Loser Pays Rule: The losing party shall bear all costs of the arbitration, including administrative fees, arbitrator fees, and the prevailing party’s reasonable attorney’s fees.
• Customer Responsibility: Notwithstanding the Loser Pays Rule, the customer agrees to pay:
  • An initial filing fee of $250 or equal the  half amount value of the filing fee.
• Additional Costs: The customer shall be responsible for any costs exceeding the cap, including but not limited to extended hearing fees, arbitrator travel expenses, and additional arbitrator compensation beyond 7 hours at a rate of $300 per hour or equal the actual value per hour.
• My Secret Studio LLC prevails, it shall be entitled to full reimbursement of all costs If My Secret Studio LLC loses, its maximum liability for costs shall be capped at $1000.
• Small Claims Exception: For claims under $1,000, parties may opt to use Florida’s small claims court instead of arbitration.

 

9,4. Venue & Governing Law

• Location: All arbitrations will occur in Miami-Dade County, Florida, as referred to in 9.2 point.
• Governing Law: Florida law and the Federal Arbitration Act govern this agreement.

9.5. Class Action Waiver
Claims must be brought in an individual capacity, not as a class action, collective action, or consolidated proceeding.

9.6. Confidentiality
All arbitration proceedings and outcomes are confidential unless required by law.

9,7. Survival Clause
This arbitration agreement survives termination of services or products.

10. Entire Agreement

These Terms and Conditions, along with our Privacy Policy and any other legal notices published by My Secret Studio LLC on the website, shall constitute the entire agreement between you and My Secret Studio LLC concerning the use of our website, products, and services.
